    Under S.33 of the EPA 1990 (amended in 1995), it is an offence to:Deposit or knowingly cause or knowingly permit to be deposited (controlled) waste in or on land unless in accordance with the terms of a waste management licence
    Treat, keep or dispose of controlled waste in land or by means of any mobile plant unless in accordance with the terms of a waste management licence
    Treat, keep or dispose of controlled waste that could cause environmental pollution or harm human health. (This offence applies even in situations where a waste management licence is not required.)

    • I rang them same thing, also spoke 2 the wigan reporter who originally covered the story in wigan, keep the pressure on, see u 2nite, !
    • I HAVE JUST RANG THEM & THEY ADMITTED IT WAS THEM!!! THEY SAID THEY ENTERED INTO A BUSINESS DEAL WITH THE LAND OWNERS IN ‘GOOD FAITH’. APPARENTLY THEY ARE WORKING WITH THE LAND OWNERS TO GET IT RESOLVED & APOLOGIZED FOR IT.

      THE Environment Agency has reprimanded a Wigan company after their waste storage operations caused an infestation of flies.
    As I have walked down the lane leading to Brookside recently I have noticed the lane being practically flooded with water coming from this area and running straight into the brook, I’d like to know whether this water has been in direct contact with the dumped waste? If so, what effect could that have on our local environment eg wildlife or dogs drinking from it, children playing in it etc?

      • Martina Burns I am more worried about the possible water pollution too. This waste has been there for a while and it has only been the terrible weather that has kept the flies under control. However, that weather will undoubtedly have caused at least a level of pollution by washing bacteria from the waste into our brooks. I think this needs to be addressed strongly tomorrow
  • I want to know what is exactly in these rubbish bags and as this contaminated the water up there? What are the council going to do about this and how quickly will they take action? What are the health implications for everyone? I have an 11 week old baby and I cant feed her in our front room for the flies. They are landing on her, her bottles, her bib and her toys. Its disgusting.

      • Rachael Gallagher Can’t believe all of this has been going on right under our noses! I walk my dog round Brookside every day (well, used to!) and had no idea!!
      • Janet Stonham What a f***ing discrace. Im beyond mad now, felt sick to my stomach after seeing that mess and it only across the road. Just put my daughter to bed and two flies in her bedroom, having to spray while she is in the same room. Something better b done about this pretty sharpish!
        I have a question for tomorrow: How are the council going to deal with vulnerable people coping with the flies? E.g., the elderly – there are numerous care homes near the waste, and they are definitely at risk of infection. Surely this must urge the council to clear the waste immediately?

        So the EA are advising anyone who has been bitten to seek medical attention. I have been bitten but I’m not going to put extra strain on the NHS for a bite, it could have been a midgie bite for all I know. I’ll keep a close eye on the bite though. My question is are the EA going to inform the hospitals and GP’s of their advise because as someone who works in the NHS I can tell you now a doctor would send people away saying keep an eye on it.
